The Proprietor of the Houston Texans Engages in Legal Battle Against Son’s Attempt to Declare Her Incapacitated

Amidst the Houston Texans’ celebratory season, clinching the AFC South title and heading into the playoffs, internal discord within the McNair family has surfaced.

Court records reveal that the owner, Janice McNair, is resisting her son Robert Cary McNair Jr.’s pursuit to have her declared incapacitated and a guardian appointed on her behalf.

The legal saga unfolded in November when Robert Cary McNair Jr. filed a petition with the probate court in Harris County, seeking the appointment of a guardian for his 87-year-old mother. The application, which outlines the reasons for declaring her incapacitated, was temporarily sealed by a judge last month.

In response to the legal maneuver, attorneys representing Janice McNair and her other son, Cal McNair, who serves as the chairman and CEO of the Texans, expressed their shock at Robert Cary McNair Jr.’s actions.

They characterized his measures as “drastic and unwarranted,” alleging that he aims to strip his mother of her rights and assume control over her personal, financial, and medical decisions. Both Janice McNair and Cal McNair vehemently deny any suggestion of Janice’s incapacity.

In a sworn affidavit spanning two pages, Janice McNair, who assumed ownership of the Texans following her husband’s passing in 2018, requested the sealing of all court records related to the case to safeguard her confidential personal, financial, and medical details.

She emphasized the potential adverse effects of the family dispute becoming public, expressing concern about its impact on the Texans, its employees, business partners, and overall direction.

To address the confidentiality concerns, Judge Jerry Simoneaux conducted a hearing on the matter, subsequently ordering additional information before making a final decision. The judge retained the temporary sealing of Robert Cary McNair Jr.’s guardianship application.

Attorneys representing the involved parties did not offer immediate comments, and the Texans organization declined to provide any statements on the ongoing situation.
